员工离职协议书篇一
乙方(职工): (身份证号码: )
乙方因个人原因向甲方提出辞职申请,经公司领导批准,产生本协议所涉乙方离职事由,双方本着平等自愿、协商一致的原则,就乙方离职事宜签订以下协议,供双方共同遵守执行。
一、双方劳动合同关系自 年月日起解除。
二、乙方因个人原因,需将人事关系暂存于甲方,由甲方继续代乙方缴纳社会保险费用,所产生的社会保险费用(包括甲方应承担部分)全部金额由乙方自行承担。并按当年社保基数在每年2月、8月各缴纳6个月的费用。
三、乙方如需停止缴纳社会保险费用,需书面送达甲方,并作为本协议附件。乙方有效身份证明文件附后。
四、乙方确认,与甲方不存在任何劳动争议,或者均已明确放弃因建立双方劳动合同关系而致的乙方所有权益,若因此成讼,均应由乙方承担全部不利的法律后果。
五、 在签订本协议时,双方正式终止劳动合同关系,此后,双方互不负任何权利义务关系。
六、在签订本协议时,双方均已十分清楚包括《劳动法》、《劳动合同法》在内的相关法律、法规之规定,知晓协议行为的法律后果,且愿意履行本协议内容。
七、因本协议产生的争议,甲乙双方应先协商解决,协商不成,提交所在地法院进行诉讼。
八、本协议共一式二份,由甲、乙双方各执一份,二份内容完全相同,均具有同等法律效力,本协议经双方签字(章)后生效。
